We, us or our refers to Chrysos Corporation Limited, of 2A Venture Road, Tonsley SA 5042, Australia and our group entities.
You may only use the Online Services for lawful purposes, and must ensure that your use of the Online Services does not breach any laws that apply to you.
The content of our Online Services is general information only and does not constitute technical, commercial or professional advice, nor does it create any formal relationship between us and you or any other person. You must not rely upon the content of our Online Services without obtaining specific advice tailored to your particular circumstances.
While we use reasonable care and skill to ensure that the content of our Online Services is accurate, complete, up-to-date and reliable, we do not warrant that this will be the case or that your access to the content will always be uninterrupted, timely or secure. Unless stated otherwise, we own or license the copyright and all other proprietary rights in the content of the Online Services (including any text, trade marks, images, logos, animations, sound recordings and/or software). PhotonAssay™ is a trade mark of Chrysos Corporation Ltd.
You do not obtain any licence or other interest in that intellectual property beyond the right to use the Online Services as provided for in these Terms of Use. Nothing in these Terms of Use is to be construed as granting any rights inconsistent with this paragraph.
You may not, without our prior written permission, reproduce, display, store, print, publish, distribute, commercialise, perform, adapt, or create derivative works from any materials you acquire from our Online Services other than for the purposes of, and subject to the conditions prescribed under, the Australian Copyright Act 1968 (Cth) and as required for your effective use of our Online Services.
Any word or logo which appears in our Online Services in association with the ™ or © symbol is a trade mark or copyright notice, and must not be used by you unless in accordance with the requirements of the Australian Trade Marks Act 1995 (Cth).
We cannot ensure the security or integrity of any information you send to us via the internet during its transmission. Accordingly, any information you transmit in that manner will be sent at your own risk. However, once we have received information, we will take reasonable steps to ensure it remains secure in accordance with our Privacy Policy.
We recommend that you do not provide us with confidential information via our Online Services unless you accept the risk that the information may be lost, corrupted, or accessed by third parties during its transmission.
We will not be liable for any interference or damage you may suffer in connection with your use of the Online Services, including data loss, damage to hardware or software, and any damage caused by computer viruses, malicious computer code or any other form of interference. We may amend these Terms of Use at any time and, if we do so, we will provide the updated version on our website. Your continued use of our Online Services following any such amendment constitutes your acceptance of the revised Terms of Use.
These Terms of Use are governed by the laws in force in the State of South Australia, Australia. In respect of all matters connected to the Terms of Use, you irrevocably submit to the exclusive jurisdiction of the Courts of that jurisdiction and any Courts of appeal from them.
If any of these Terms of Use are held to be void, invalid, unenforceable or illegal for any reason, the remaining Terms of Use will continue to apply. If we waive any rights available to us under these Terms of Use, that does not mean that those rights are waived on any other occasion. We will have no liability for any failure to comply with these Terms of Use where such failure is due to circumstances beyond our reasonable control.
